


DWI, DUI and/or Refusal in Seaside Heights

You can be charged with a DWI related offense if you are operating a motor vehicle with a BAC of 0.08% or over, or are determined by a law enforcement official to be under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug while operating motor vehicle.
Penalties can be quite severe depending on the level of the offense. For a first DWI offense with a BAC between 0.08% and 0.10% you may be forced to pay significant fines of up to $400.00 plus other administrative costs and fees, could lose your license for up to 3 months, the court at its discretion may require you to install an interlock device in your motor vehicle, and you could spend up to 30 days in jail. For a first offense with a BAC between 0.10% and 0.15% you could be forced to pay a fine of up to $500.00 plus other costs and fees, spend up to 30 days in jail, lose your license for a minimum of 7 months or a maximum of up to 1 year, and at the courts discretion, you might be required to install an ignition interlock device. For a first offense with a BAC of over 0.15%, you could lose your license for a minimum of 7 months up to a maximum of 1 year, pay fines of up to $500.00 plus other costs and fees, spend up to the 30 days in jail, and the court will require you to install an ignition interlock device. You will also be required to complete 12 to 48 hours of detainment and/or counseling prescribed by the Intoxicated Driver Resource Center (IDRC). As the number of offenses increases the penalties become much more severe. DWI charges in Seaside Heights and in all of New Jersey are not easy to overcome.
