Often, Seaside Heights Police Officers will arrest a person for possession of marijuana under 50 grams. If a loud house party gets out of control and Seaside Heights Police Officers find evidence of drugs or paraphernalia while responding to a noise complaint, the individuals involved will suffer the consequences of a disorderly persons charge. If the amount of marijuana is over 50 grams, the offender could face more serious fines and penalties and could be charged with a 4th degree or higher degree crime. The same holds true for other Controlled Dangerous Substances (CDS) that are placed on a tiered schedule within the New Jersey Statutes.

It is unlawful to knowingly or purposefully obtain or possess a controlled dangerous substance.  The possession of drugs can be actual or constructive.  Actual possession would be drugs found on your person and constructive possession would be drugs found in your immediate vicinity that you may have control over.  Constructive possession cases are sometimes difficult to prove for the prosecutor when multiple individuals are in a room or passengers in a automobile.  The police will charge all individuals in the immediate vicinity and then let the prosecutor decide whose drugs they were through further investigation.
